An expungement of an arrest record can only be utilized in a few very narrow and limited circumstances. An expungement is a procedure that can only be used to remove a record of an arrest from your record; it cannot be used to remove any conviction from your criminal history (to remove of conviction from your record one must seek a pardon or sentence modification depending on the circumstances). An expungement of an arrest record can only be sought under three circumstances. First, one can seek the expungement of an arrest record one year after the arrest if no accusatory document (complaint or indictment) was filed by the prosecutor. Second, one can seek the expungement of an arrest record if one year has passed since the prosecutor has dismissed the entire criminal case against you on the record.
