An expungement is a procedure that can be used to remove a record of an arrest or criminal charge from your record. An expungement cannot be used to remove a conviction from your criminal history. If you are seeking the removal of a criminal conviction from your record, you may be able to seek a pardon or sentence modification depending on the circumstances.
The expungement of an arrest record can only be sought under three circumstances. First, one can seek the expungement of an arrest record one year after the arrest if no accusatory document (complaint or indictment) was filed by the prosecutor. Second, one can seek the expungement of an arrest record and criminal charge if one year has passed since the prosecutor dismissed the entire criminal case against you on the record.
